We would like to inform you about significant amendments to ****Federal Law No. 248-FZ dated July 31, 2020 On State Control (Supervision) and Municipal Control in the Russian Federation****, introduced by ****Federal Law No. 540-FZ dated December 28, 2024****. The new regulation came into effect on ****December 28, 2024****, with certain provisions set to be implemented later.

KEY CHANGES:
  • New grounds for unscheduled inspections: These include the presence of risk indicators, failure to conduct mandatory preventive visits, and lack of registration in the “Chestny Znak” system where required.

  • Mandatory preventive visits: Avoidance of these visits is now considered grounds for unscheduled inspections.

  • Risk-based approach: The frequency of inspections and visits is now determined by the risk category of the company.

  • Agreements on eliminating violations: Companies may enter into agreements with supervisory authorities to eliminate violations that require significant resources.

  • Digitalization of inspections: Supervisory authorities are implementing the use of the “Inspector” mobile application for remote inspections and visits.

  • Public compliance ratings: Companies will now receive public ratings of their compliance with regulatory requirements, accessible to third parties.

IMPACT ON BUSINESS:

As of 2025, the President of the Russian Federation has proposed lifting the moratorium on business inspections and fully transitioning to a risk-based approach. This shift could lead to an increase in the number of inspections. Employers must begin adapting to these changes now to mitigate potential risks.

RECOMMENDATIONS FROM ALRUD:
  • Conduct an HR audit of processes, including employment contracts, payroll, disciplinary sanctions, data protection, and workplace safety.

  • Prepare for mandatory preventive visits and unscheduled inspections.

  • Ensure compliance with the law to avoid sanctions and reduce your company’s risk category.
