The volatile geopolitical landscape and ongoing sanctions pressure are driving the evolution of countersanctions regulation and enforcement practice. Restrictions on capital outflows and policies aimed at retaining capital within Russia have left funds trapped domestically, with limited options for transferring them abroad. Challenges relating to dividend distributions, profit allocations, and loan repayments are intensifying, alongside recent changes to banking deposit rules. As a result, businesses are increasingly accumulating cash reserves — an approach that cannot serve as a long-term strategy and that leaves them vulnerable under current circumstances.

It is now crucial to align our shared understanding of the current regulatory environment, identify the key countersanctions restrictions in force, and analyse recent enforcement practice and what it means for those who breach the regime. We must also consider which actions may attract regulators' attention and potentially trigger interim (external) administration mechanisms.

Drawing on our experience, we will explore management and de-risking strategies to safeguard capital against regulatory risk and help businesses navigate this complex landscape more securely.
