Since February 2022, western sanctions authorities are estimated to have frozen c.$60 billion in private assets of sanctioned Russian persons.
In response, the Russian state enacted laws purporting to allow sanctioned Russian persons to seek recovery of those assets before the Russian Courts. This has spawned well over 100 claims against non-Russian institutions, contrary to jurisdiction agreements.
This places the affected non-Russian institutions in a complex scenario. Sanctions compliance, risk mitigation and litigation strategy all need to be considered.
