«Dispute is a legally driven process. It requires recording all the circumstances, roles, procedure. The effective model relies on a clear separation of roles within the company. In practice, lawyers often get involved at a late stage of a conflict that is a mistaken position. In my experience, informal discussions rarely lead to a resolution. In this regard, the courts proceed from the premise that any doubts are interpreted in favour of an employee, and the employer’s written documents are often treated with skepticism. That is why it is so important to establish a compliance system,” Margarita notes.
