19 October 2026
On 15 October 2026, ALRUD and Fersol held a joint webinar «Dismissal negotiations: HR practical experience and legal case studies». Margarita Egiazarova, Partner and Head of ALRUD Labour Law Practice, and Vladlena Girina, business consultant specialising in outplacement, discussed how to conduct dismissal negotiations in a way that balances the interests of both the employee and the employer, and mitigate the risk of labour disputes.
In her speech, Margarita Egiazarova addressed current judicial approaches to dismissal by mutual consent and voluntary resignation. Special emphasis was placed on the shift in judicial review from verifying compliance with formal requirements to assessing the voluntary nature of the employee’s intention and the circumstances preceding the dismissal.
The speaker analised the key risks involved in negotiating the termination of an employment agreement, the circumstances that may indicate the employee was forced to resign, and the position of the Supreme Court of the Russian Federation. Margarita particularly focused on situations requiring special attention from the employer: initiating dismissal, the existence of a prior conflict, preparing and submitting a resignation letter, determining the termination date, and the employee’s ability to withdraw the resignation letter. As part of the discussion on dismissal by mutual agreement, Margarita also presented a checklist to verify the legality of the procedure.
In conclusion, Margarita presented key preventive solutions and practical recommendations to help employers properly implement the dismissal procedure, mitigate legal risks, and strengthen their position in the event of a legal dispute.
