On December 8 ALRUD Labour and Employment practice held a workshop for clients “Results of 2015: learning from the experience of others. Plans for 2016”. Irina Anyukhina, Partner, Maria Gnutova, Senior Associate, Kristina Teplova and Anastasia Tropynina, Senior Attorneys, covered topical issues including:

  • Legislative review: explanations of State Labour Inspection. Court practice.

  • Staff redundancy: actions that may result in reinstatement in employment.

  • Dismissal due to disciplinary breaches: factors and circumstances to be taken into account when making a decision on dismissal.

  • Dismissal by mutual agreement of the parties: multi-function alternative entailing no risks.

During the workshop, the experts provided professional recommendations and advice concerning landmark and thought-provoking case law demonstrating ineffectual approaches to settlement of labour disputes, effective methods of protecting the employer’s interests, major legislative changes (either already in force and expected to be enacted in 2016) that shall require adjustments in the companies’ practice.

During the second part of the workshop, “Changes in the labour legislation that you should be prepared for”, ALRUD experts told of the labour legislation changes having recently come into effect, as well as changes to come into force in 2016, from setting a time period for the employer to substantiate the refusal to hire an applicant, to prohibition of agency labour.
