ALRUD experts prepared an article on the possibility of a cession of rights under a lease agreement for a public land plot in Russia

Sabina Idrisova, Paralegal of ALRUD’s Real Estate Practice, co-authored an article on the topic: “Transfer of lease of a land plot: Notification, Consent or Nullity?”, published in the journal “Bulletin of Economic Justice of the Russian Federation”.

The article considers the problems of the possibility of transferring rights and obligations from a lease agreement for a public land plot. In particular, it analyzes approaches of judicial practice and the practice of application of the norms of civil, land and forest legislation by antimonopoly authorities. This is in the light of the prohibition, by the Civil Code of the Russian Federation, of the assignment of rights under a contract, concluded at auction.
