On September 21st, the experts of Labour and Employment Practice of ALRUD Law Firm opened a series of online events, prepared specifically for members of Coleman Services Industrial and HR Clubs, by holding a webinar "Compliance in the Workplace: Legal Ways of Ensuring, Investigating of Unfair Actions, and Liability Issues". The ALRUD experts at the event were Irina Anyukhina, ALRUD Partner, and Anastasia Petrova, ALRUD Of Counsel.
The effectiveness of compliance systems is largely predetermined by timely implementation of local policies and trainings on their compliance. This is judged when using the monitoring and operational controls in the workplace, including the investigation of incidents. This approach enables the business to conduct its activities smoothly, while reducing potential financial costs and reputational risks. Internal compliance processes should be considered the norms of Russian laws and the established judicial and law enforcement practice.
ALRUD experts described the preventive measures that can be taken, investigation procedures, their documentation, and the use of investigation results, in the context of possible accountability measures. Particular attention was paid to practical aspects of investigations and practicable methods for resolving them, subject to applicable rules of Russian labour, civil, and criminal law, as well as the legislation on personal data. The subsequent active discussion highlighted the importance and relevance of the topic.
