17 May 2022

On May 17 experts of ALRUD Labour Practice held a webinar "Topical judicial practice on labour disputes: what is important to consider?", prepared specially for the members of Coleman Services HR Industrial Club and HR Dialogues Clubs. The experts at the event were Irina Anyukhina, ALRUD Partner, and Margarita Egiazarova, Senior Associate.

In recent years, the ALRUD team has represented its clients in a significant number of complex and ambiguous court cases. At this event, the experts shared their expertise and spoke about decisions that had changed the courts' established approaches in considering labour disputes.

The webinar covered the following questions:

  • Increase in the number of risks associated with the termination of an employment agreement by agreement of the parties
  • Procedure for offering vacant positions in case of staff reduction
  • Invalidation of an administrative leave granted at the employer's initiative
  • Introduction of downtime in the light of new court practice
  • Change in the approach to considering disciplinary cases
  • Abuse of preferences by protected categories of employees

Together with the webinar participants, the speakers analyzed the prevailing positions of the courts when considering labour disputes, which were applied in actual cases of ALRUD Labour Practice.
