Margarita Egiazarova, Partner in ALRUD Labour and Employment Practice, PhD in Law, prepared a commentary for the professional magazine “Trudovye Spory” on “How to deal with legislative amendments in 2025. Advice from labour law lawyers”.
Margarita covered the new regulations relevant to payment for unused compensatory leave at dismissal.
Given the fact that the procedure for granting days off and compensation for work on weekends and public holidays was not clearly regulated, the revised version of the Labour Code introduces alterations that can eliminate the problems that existed previously.
Based on the restated Art. 153 of the Labour Code, that will come into force on March 1, 2025, in her commentary Margarita offered some advice to the employers.
“Due to alterations the employers should pay special attention to personnel record keeping and adapt management processes to comply therewith. It’s important that compensation amounts be calculated accurately at dismissal not to afford grounds for potential claims.
Training for permanent staff on the new accounting rules and compensation payment regulations can help to prevent errors. Moreover, it is essential to conduct an assessment of financial obligations related to the compensation for the unused compensatory days off and take them into account in the long-term planning”, - Margarita recommends.
