Margarita Egiazarova speaks at the annual AEB HR-Conference “Human Resources in 2025: Challenges we accept”

On March 26, 2026, Margarita Egiazarova, Partner and Head of the Labour Law Practice at ALRUD, PhD in Law, took part in the annual HR-conference of the Association of European Businesses (AEB) “Human Resources in 2025: Challenges we accept”.
Margarita spoke on the topic “Termination Practice for No-Fault Grounds: Voluntary Resignation and Mutual Agreement”.
The expert provided the up-to-date judicial practice including reviews of rulings of the courts of general jurisdiction (1st – 9th General courts of cassation) for the years 2024-2026. The focus was on the issues of assessing the voluntariness of an employee’s resignation, expanding the employer’s duties upon an employee’s voluntary resignation, and “red flags” in case of termination of an employment contract by mutual agreement of the parties.
Margarita Egiazarova drew the attendees’ attention to the key risks for the employers: the form of a resignation letter is no longer a formality, the same day dismissal is increasingly recognized by courts as illegal, communication via messenger does not replace an original application, and the employer is obliged to explain to the employee the consequences of signing a mutual agreement and take into consideration his/her financial position.
Upon completion of the report, the attendees received practical recommendations and checklist to mitigate the risks of reinstatement of employees in a judicial proceeding.
This year’s Program of AEB Conference comprised the discussion of innovative methods in a plenary session and practical parallel sessions organized by the AEB Recruitment and Relocation Sub-Committee, Compensation and Benefits Sub-Committee, Assessment, Training and Development Sub-Committee, and Labour Law Sub-Committee.
