Margarita Egiazarova speaks at the anniversary conference of UMMC lawyers in Verkhnyaya Pyshma

Margarita Egiazarova, Partner and Head of the Labour Law Practice at ALRUD, PhD in Law, took part in the annual conference of UMMC legal departments which was held for the 25th time in Verkhnyaya Pyshma.
Margarita presented a report on “The practice of dismissals on faultless grounds: voluntary resignation and mutual agreement”. Margarita analyzed the key risks for employers: courts are increasingly evaluating not only formal documents, but also the voluntary nature of an employee’s decision, taking into account his/her family and financial circumstances and state of health. Special emphasis was put on “red flags” in case of dismissal by mutual agreement of the parties (lack of time for familiarization, the same day dismissal, non-payment of severance benefit) and expanded options for employees to withdraw the letter of resignation.
Margarita also presented a checklist for the legality of a dismissal procedure and recalled the consequences of the employer's defeat in court: employment reinstatement, payment for forced absence, compensation for moral damage.
This year's conference program, in addition to the labor bloc, also covered environmental law, PPP and personal data regulation.
