Ekaterina Bronitsyna speaks at an online meeting of SPIBA on current labour disputes

On 21 October, an online meeting of the St. Petersburg International Business Association (SPIBA) took place. It focused on current labour disputes and the practice of Russian courts. The experts discussed key trends in judicial practice and practical issues in the application of labour law.

Ekaterina Bronitsyna, Senior Associate, ALRUD Advocate, spoke on trends in judicial practice relating to dismissal disputes.

In her presentation Ekaterina addressed courts’ current approaches to dismissals by mutual agreement and voluntary resignations. Special attention was paid to the circumstances that may indicate that a settlement agreement was concluded under pressure or that the employee’s consent was not given voluntarily, as well as to the position of the Supreme Court of the Russian Federation on these matters.

The speaker also analysed the key risks when initiating a dismissal, the specifics of drafting and submitting a resignation notice, the determination of the date of termination of employment, and the expansion of an employee’s ability to withdraw a resignation notice. Special attention was paid to the main criteria for verifying the lawfulness of dismissal by mutual agreement and practical advice on mitigating the risks of employment disputes.

In conclusion, Ekaterina highlighted preventive solutions to help employers implement a proper dismissal procedure and mitigate the risks of their decisions being challenged in court.
