ALRUD dispute resolution team successfully represented interests of JSC “TVEL” in a dispute on protection of business reputation with Westinghouse Electric Company LLC.
JSC “TVEL”, a State corporation “Rosatom” company, is the only Russian nuclear fuel exporter.
In 2012, the Vice-president of Westinghouse Electric Company LLC, American competitor of JSC “TVEL”, in an interview to a leading Ukrainian business periodical stated that when used in South-Ukrainian nuclear facility, JSC “TVEL” nuclear fuel caused deformation of nuclear fuel produced by Westinghouse Electric Company LLC.
JSC “TVEL” filed a claim on protection of business reputation with the Arbitrazh court of the city of Moscow against Westinghouse Electric Company LLC, Ukrainian periodical editor’s office, and the author of the article. The procedure was complicated by the fact that the Ukrainian defendants avoided appearing in court hearings, so they had to be notified via the Ukrainian justice institutions.
Several expert opinions, including linguistic and technical, were included in the case.
Arbitrazh court of the city of Moscow satisfied the claim of JSC “TVEL”, held that the abovementioned statements discredit business reputation of JSC “TVEL”, and obligated the plaintiff – the Ukrainian periodical – to publish the substantive part of the resolution on its Web site.
