Concise and to the point with ALRUD (№ 5)

25 February 2025

Stay up-to-date with the latest developments in ****Russian labour law**** that will come into force on ****March 01, 2025****. These updates are essential for ensuring accurate payroll calculations, particularly in cases of employment termination, formalizing mentoring, and for aligning local policies with current legal requirements.

Changes to Compensation for Unused Days Off

Effective March 01, 2025, employers will be required ****to compensate**** employees upon dismissal for unused days off accrued from ****working on weekends or public holidays**** throughout their period of employment.

Specifically, if an employee opted for a day off ****instead of receiving higher pay**** for work performed on such days but did not ultimately use the day off, they will be entitled to the ****difference**** between the higher applicable payment and the actual payment received.

The new law provides that, ****employees may request**** to use a day off earned for work on a weekend or public holiday either (1) within one year of the date of such work or (2) by adding it to their leave during the designated period.

Ground: ****Federal Law No. 339-FZ dated September 30, 2024****

Mentorship

From 1 March 2025, the Labour Code will regulate the ****mentorship****. According to the law, mentorship may be assigned only on the basis of the ****employee's written consent**** and specifying the ****content****, ****terms**** and ****forms**** of the mentor's functions in the employment contract.

****Payment**** for such work may be established by agreements between the parties, collective bargaining agreements or employer's local policies.

The employer or employee shall notify the other party at least 3 business days in advance about the ****cancellation**** of mentorship.

Ground: ****Federal Law No. 381-FZ dated November 9, 2024****

We strongly recommend that companies ****review**** their current labour procedures and ****update**** their local policies to reflect these changes.
